3. Procedure for booking rooms, entering into a contract for hotel services, and paying for services
3.1. The hotel has the right to enter into a contract with the customer/consumer for room reservations by having both parties sign it, as well as by accepting the customer’s/consumer’s reservation request via mail, telephone, fax, or other means of communication (email, the hotel’s website, etc.) that allows for the reliable verification that the request originates from the customer or consumer. The contract is considered concluded and the room reservation is made only upon the hotel’s written acceptance of the reservation request sent to it (i.e., confirmation of the reserved services) and upon the parties reaching an agreement in the prescribed form regarding all material terms and conditions for the provision of hotel services.
3.2. If, when booking hotel services, the customer is not the same person as the consumer, the customer undertakes to correctly and fully indicate the following information in the contract or in the reservation request, as well as subsequently in the payment document for the reservation (if the customer is the payer) to correctly and completely specify the following information:
– information about the consumers (last name, first name, patronymic) for whom the reservation is made, their number, with a separate indication of the number of children and their ages;
– details of the documents identifying such consumers;
– the period for which hotel services are being reserved (length of stay);
– the hotel rooms being reserved.
The customer is solely responsible for the accuracy of the information provided during the booking process, as well as for ensuring that the customer possesses the appropriate legal authority to make the booking on behalf of and/or for the benefit of the guests.
3.3. When booking a room, the hotel has the right to request an advance payment for hotel services in amounts determined by the hotel at its discretion.
3.4. The prepayment for hotel services at the time of booking must be paid in cash or by non-cash means (by transferring the corresponding amount to the hotel’s current bank account) no later than within three banking days following the date of confirmation of the reserved services, but no later than 24 hours before the check-in date. Such a prepayment is subsequently credited toward the consumer’s/customer’s payment for basic hotel services, unless otherwise specified in the reservation agreement concluded with the customer/consumer.
A separate booking agreement concluded with the customer/consumer may provide for a different timeframe or deadline, agreed upon by the parties, for making the prepayment for hotel services at the time of booking.
3.5. If the customer/consumer refuses to make an advance payment for hotel services at the time of booking, or if the customer/consumer fails to make such an advance payment by the deadline specified in the first paragraph of subparagraph 3.4 of these Rules, the consumer’s accommodation at the hotel will be arranged on a first-come, first-served basis (i.e., without regard to the reservation), and, accordingly, the hotel reserves the right to cancel the reservation without notifying the consumer if the consumer does not arrive by 6:00 p.m. on the day of check-in.
3.6. The consumer (customer) has the right to cancel a reservation confirmed by the hotel by sending a written cancellation notice to the hotel’s email address res@nadiyahotel.com or by calling +38 050 4337522. Cancellation of a reservation is free of charge if made at least 24 hours prior to the customer’s check-in date.

3.8. A contract for the provision of basic hotel services to a consumer is considered concluded after the accommodation documents have been processed (completion and signing of the registration card) and is evidenced by a payment receipt or other payment document confirming the conclusion of the contract
3.9. A contract for the provision of basic hotel services may be concluded by a client on behalf of the consumer and/or at the consumer’s request.
3.10. A contract for the provision of hotel services may be concluded for a fixed or indefinite term.
When entering into a contract for an indefinite term, the shortest period—typically one day—is deemed to have been agreed upon; in such cases, the contract expires at 12:00 p.m. on the day following the guest’s arrival. The guest must notify the hotel front desk of their intention to extend their stay by 10:00 a.m. on the day of departure. The stay at the hotel will be extended subject to availability.
3.11. The hotel has the right to apply freely set prices, rates, and a discount system to all services provided, with the exception of those subject to state regulation of prices and rates.
3.12. Room rates, the list of additional services, and their costs are set by the hotel independently; the form of payment is determined by the agreement between the consumer/customer and the hotel.
3.13. The hotel charges for hotel services on a per-night basis; that is, the price of hotel services is specified per night of stay, which is considered the minimum billing (base) period for the provision of hotel services.
3.14. The check-out time at the hotel is: 12:00 (twelve o’clock) of the current day, local time.
Fees for hotel services are charged in accordance with the specified standard check-in time.

For stays of less than one day, payment is made for a full calendar day in accordance with the established check-in time
3.15. The hotel charges additional fees for early check-in and late check-out, specifically:
— early check-in from 12:00 a.m. to 12:00 p.m. is subject to an additional charge of 60% of the room rate for 1 (one) billing day, in accordance with the current rate.
– Late check-out from 12:00 p.m. to 12:00 a.m. is subject to an additional charge of 40% of the room rate for 1 (one) billing day, in accordance with the current rate.
3.16. In the event of early departure from the hotel, the guest agrees to notify the hotel front desk by 10:00 a.m. on the day of departure. If the room is vacated by 12:00 p.m. on the current day, the guest will be refunded the amount previously paid for the unused days of stay.
Refunds for unused stays/services are processed as follows:
– the administrator receives the guest’s previous payment documents upon presentation of a passport or other form of identification;
– the guest fills out a “Request for Refund of Unused Funds” addressed to the hotel management;
– the administrator refunds the guest the amount corresponding to the unused services;
– the guest receives payment documents for the services actually received.
3.17. Hotel services may be paid for: by bank transfer (by transferring the corresponding amount to the hotel’s current bank account), in cash, or by credit/debit card.
3.18. The fee for basic hotel services must be paid in full by the customer/consumer for the entire planned period of use of such services to the Hotel as an advance payment no later than the check-in date.
The final settlement (including, if applicable, the cost of additional hotel services provided (such as local, long-distance, and international telephone calls), the cost of any damages caused, fees for hotel services in the event of the guest’s late checkout, etc.) must be paid by the guest no later than the day of checkout.
3.19. When children under three years of age are accommodated in the same room as their parents (i.e., without a separate bed), no accommodation fee is charged for the children (except for services not included in the room rate).
3.20. For the entire duration of their stay at the Hotel, guests must pay a tourist tax in the amount established by a resolution of the Ivano-Frankivsk City Council. The following are exempt from paying the tourist tax, subject to presentation of supporting documents: persons who permanently reside, including under a lease agreement, within the territory of the Ivano-Frankivsk City Council; persons specified in subparagraph “c” of subparagraph 14.1.213 of paragraph 14.1 of Article 14 of the Tax Code of Ukraine (individuals—residents—who have their place of residence in Ukraine) who have arrived on a business trip; persons with disabilities and persons accompanying persons with Group I disabilities or children with disabilities (no more than one accompanying person); war veterans; participants in the cleanup of the Chernobyl nuclear power plant accident; and children under the age of 18; persons registered as internally displaced persons in accordance with the Law of Ukraine “On Ensuring the Rights and Freedoms of Internally Displaced Persons” who are temporarily staying at a hotel, and the address of such persons, as indicated in the certificate of registration as an internally displaced person, is the address of their actual place of residence or stay.

4. Procedure for Providing Hotel Services

Documents that serve as proof of identity include: a Ukrainian passport; a Ukrainian passport for travel abroad; a diplomatic or service passport; a seafarer’s identity card; a residence permit for a person residing in Ukraine but who is not a citizen of Ukraine; a foreigner’s national passport or a document serving as its substitute, and a visa granting the right to stay in Ukraine (unless otherwise provided by applicable bilateral agreements); a birth certificate for minors under the age of 16; a driver’s license; for military personnel—a military ID or military service card; an identification document issued by the consumer’s employer, etc.
In order to identify guests and to ensure that the hotel, as a tax agent, properly maintains tax records regarding the withholding of the tourist tax, the hotel retains copies of documents that verify the identity of the guest and of the individuals staying with them in the room.
If a guest refuses to present documents proving his or her identity and the identities of the individuals staying with him or her in the same room, and/or refuses to fill out and sign the registration form, and/or refuses to allow the hotel to make copies of their identification documents, the hotel reserves the right to refuse to provide hotel services to such a guest.
4.2. After completing the check-in paperwork at the hotel and paying for hotel services, the guest is issued a receipt for payment of services and a room key. If the guest loses the key, they must pay the cost of the key as listed in the price list.
4.3. The hotel has the right to refuse to provide a room to a guest or to refuse to continue providing hotel services (to unilaterally terminate the contract for the provision of hotel services early at the hotel’s initiative and evict the customer/guest) if at least one of the following grounds exists:
– the inability to identify the customer due to the customer’s failure to present identification documents, or the customer’s refusal to do so, or because the documents provided are invalid or expired, as well as in cases where there is suspicion that the documents are forged;
– the consumer’s refusal to complete and sign the registration card;
– failure to pay, late payment, and/or partial payment for hotel services;
– the guest is in a state of severe alcohol, drug, or toxic intoxication, or is in an inappropriate state under the influence of psychotropic substances (the guest’s condition is determined at the hotel’s discretion);
– the guest is on the hotel’s list of undesirable guests (the hotel’s list of undesirable guests is a list compiled by the hotel of individuals with information indicating that they previously committed violations or failed to fulfill their obligations while staying at the hotel, etc.);
– the consumer is in possession of weapons and/or explosive or flammable substances and/or narcotic and/or psychotropic substances, and the consumer’s lack of the appropriate permits to carry or store them, or the consumer’s refusal to present such documents upon request by hotel representatives;
– the guest’s appearance is unkempt (dirty) and/or the guest exhibits aggressive behavior;
– the guest violates the quiet hours between 11:00 p.m. and 7:00 a.m.;
– the guest commits offenses;
– violation or failure by the guest to comply with the terms of these Rules or failure to observe the prohibitions and restrictions established by these Rules;
– in other cases specified by law.
If the hotel refuses to provide a room to the guest on the grounds specified above in this paragraph, such refusal shall be deemed equivalent to the guest’s failure to arrive.
4.4. The consumer has the right to terminate the contract for the provision of hotel services at any time by submitting to the hotel a corresponding request to check out of the hotel, provided that payment is made for the services actually provided by the hotel.
4.5. At the consumer’s request, a room with two or more beds may be provided upon payment of the room rate.
4.6. The hotel must ensure round-the-clock check-in and check-out services for consumers arriving at and departing from the hotel.

4.16. If any items are found to have been left behind, the hotel is obligated to immediately notify the owner of the items (provided that the owner is known). Lost items are stored at the hotel for six months, after which they are transferred to the appropriate government agencies for sale or destroyed, and a report in the prescribed form is drawn up.
4.17. The hotel administration has the right to enter a guest room at any time if this is necessitated by circumstances of self-defense or extreme necessity, force majeure, or urgent circumstances requiring the protection of life and/or property.
4.18. To ensure the safety of guests and their property, as well as visitors (guests), hotel employees, and hotel property, video surveillance is in operation in the hotel’s common areas.
